The panel will discuss how counsel conduct shapes the course and outcome of arbitral proceedings. Panellists will address the strategic and ethical boundaries of advocacy, including how to balance zealous representation of clients’ interests with realistic expectations as to the outcome of the case. The panel will consider the effectiveness of arbitrator challenges, jurisdictional objections, and similar guerrilla tactics, and whether such strategies are worth pursuing. The discussion will also examine the challenges arbitrators face in managing counsel conduct and the extent to which advocacy style may affect tribunal decision-making, procedural efficiency, costs, the integrity of the arbitral process, and reputational consequences.
